KINGWPC Algemene Voorwaarden

Artikel 1 – Definities

In deze voorwaarden wordt verstaan onder:

• KINGWPC: de verkoper van composiet producten, stalen montageproducten en aanverwante artikelen.

• Klant: iedere natuurlijke persoon of rechtspersoon die een overeenkomst sluit met KINGWPC.

• Consument: een natuurlijke persoon die niet handelt in de uitoefening van een beroep of bedrijf.

• Overeenkomst: iedere koop-, leverings- of dienstverleningsovereenkomst tussen KINGWPC en de klant.

Artikel 2 – Toepasselijkheid

1. Deze algemene voorwaarden zijn van toepassing op alle aanbiedingen, offertes, overeenkomsten en leveringen van KINGWPC.

2. Afwijkingen zijn uitsluitend geldig indien schriftelijk bevestigd door KINGWPC.

3. Eventuele algemene voorwaarden van de klant worden uitdrukkelijk van de hand gewezen.

Artikel 3 – Aanbiedingen en prijzen

1. Alle offertes zijn vrijblijvend tenzij anders vermeld.

2. Kennelijke druk-, schrijf- of prijsfouten binden KINGWPC niet.

3. Prijzen zijn inclusief BTW voor consumenten en exclusief BTW voor zakelijke klanten, tenzij anders vermeld.

4. Transport-, montage- en overige kosten worden afzonderlijk vermeld.

Artikel 4 – Bestellingen

1. Een overeenkomst komt tot stand nadat KINGWPC de bestelling schriftelijk of elektronisch heeft bevestigd.

2. KINGWPC behoudt zich het recht voor bestellingen zonder opgaaf van redenen te weigeren.

Artikel 5 – Levering

1. Opgegeven levertijden zijn indicatief en geen fatale termijn.

2. Overschrijding van een levertijd geeft geen recht op schadevergoeding of ontbinding, tenzij de wet anders bepaalt.

3. Het risico gaat over op het moment van levering.

Artikel 6 – Controle bij ontvangst

De klant dient de goederen direct na ontvangst te controleren op:

• transportschade;

• aantallen;

• zichtbare gebreken.

Klachten over zichtbare gebreken dienen zo spoedig mogelijk, bij voorkeur binnen 48 uur na levering, schriftelijk te worden gemeld.

Artikel 7 – Retourneren

Consumenten hebben, indien sprake is van een koop op afstand, het wettelijke herroepingsrecht van 14 dagen, tenzij een wettelijke uitzondering van toepassing is (zoals maatwerk).

Retourvoorwaarden:

• ongebruikt;

• onbeschadigd;

• niet gemonteerd;

• niet gezaagd of bewerkt;

• compleet;

• indien redelijkerwijs mogelijk in originele verpakking;

• voorzien van aankoopbewijs.

Retouren kunnen worden geweigerd indien:

• producten gebruikssporen vertonen;

• producten beschadigd zijn;

• producten zijn gemonteerd of verwerkt;

• onderdelen ontbreken;

• geen aankoopbewijs aanwezig is.

Maatwerkproducten, speciaal bestelde producten en op maat gezaagde materialen kunnen niet worden geretourneerd, tenzij sprake is van een fabricagefout of een foutieve levering.

Artikel 8 – Eigendomsvoorbehoud

Alle geleverde producten blijven eigendom van KINGWPC totdat de volledige factuur is voldaan.

Artikel 9 – Garantie

KINGWPC verleent een beperkte garantie van 10 jaar op de structurele duurzaamheid van composiet vlonderproducten bij normaal gebruik.

Deze garantie geldt uitsluitend indien:

• de montage is uitgevoerd volgens de actuele montagehandleiding;

• de juiste onderconstructie is toegepast;

• voldoende ventilatie aanwezig is;

• de voorgeschreven hart-op-hart-afstanden zijn aangehouden;

• originele bevestigingsmaterialen of gelijkwaardige bevestigingssystemen zijn gebruikt;

• regulier onderhoud is uitgevoerd.

Artikel 10 – Garantie is niet van toepassing op

De garantie vervalt onder meer bij:

• onjuiste montage;

• onjuist onderhoud;

• verkeerd gebruik;

• overbelasting;

• schade door brand, storm, hagel, overstroming of andere vormen van overmacht;

• schade door chemicaliën;

• schade door stilstaand water of onvoldoende ventilatie;

• normale verkleuring door UV;

• normale uitzetting en krimp;

• krassen;

• vlekken;

• slijtage;

• schade ontstaan door derden.

Artikel 11 – Stalen montageproducten

Voor stalen montageproducten geldt uitsluitend garantie op fabricagefouten.
Niet onder de garantie vallen onder andere:

• oppervlakteroest door beschadiging;

• corrosie door agressieve omstandigheden;

• foutieve montage;

• verkeerd gebruik;

• normale slijtage.

Artikel 12 – Aansprakelijkheid

KINGWPC is uitsluitend aansprakelijk voor directe schade die het gevolg is van opzet of bewuste roekeloosheid.

KINGWPC is niet aansprakelijk voor:

• gevolgschade;

• winstderving;

• vertragingsschade;

• montagekosten;

• demontagekosten;

• arbeidsloon;

• indirecte schade.

De aansprakelijkheid is beperkt tot maximaal het factuurbedrag van de betreffende levering, tenzij dwingend recht anders bepaalt.

Artikel 13 – Klachten

Klachten dienen binnen een redelijke termijn na ontdekking schriftelijk te worden gemeld, voorzien van:

• factuurnummer;

• omschrijving van het gebrek;

• foto's van het gebrek.

KINGWPC krijgt de gelegenheid het product te inspecteren voordat een garantieclaim wordt beoordeeld.

Artikel 14 – Overmacht

KINGWPC is niet aansprakelijk voor vertragingen of tekortkomingen als gevolg van overmacht, waaronder onder meer:

• natuurrampen;

• oorlog;

• stakingen;

• pandemieën;

• transportproblemen;

• overheidsmaatregelen;

• storingen bij leveranciers.

Artikel 15 – Intellectueel eigendom

Alle afbeeldingen, handleidingen, productinformatie en documentatie blijven eigendom van KINGWPC en mogen niet zonder schriftelijke toestemming worden gekopieerd of verspreid.

Artikel 16 – Toepasselijk recht

Op alle overeenkomsten is uitsluitend Nederlands recht van toepassing.

Geschillen worden voorgelegd aan de bevoegde rechter in Nederland, onverminderd de dwingendrechtelijke rechten van consumenten.

KINGWPC Returns & Warranty Policy

1. Right of Return

Customers of KINGWPC may return unused and undamaged products within 14 calendar days of receiving their order.

To qualify for a return:

• Products must be unused, uninstalled, and in their original condition.

• Products must be returned in their original packaging where reasonably possible.

• A valid proof of purchase (invoice or receipt issued by KINGWPC) must be provided.

• The customer is responsible for ensuring the products are adequately packaged during return transport.

KINGWPC reserves the right to refuse returned products if:

• The products have been installed, processed, modified, or cut to size.

• Visible signs of wear, damage, dirt, weather exposure, or improper handling are present.

• Parts or accessories are missing.

• Proof of purchase cannot be provided.

• The return request falls outside the applicable return period.

Products manufactured or supplied specifically to customer specifications, custom orders, special colours, custom lengths, or other made-to-order products cannot be returned unless they are defective or incorrectly supplied.

Return shipping costs are the responsibility of the customer unless the return is the result of an error by KINGWPC or a confirmed product defect.

Refunds will be processed after inspection of the returned goods and, where applicable, within the statutory period following acceptance of the return.

2. Warranty

KINGWPC provides a limited warranty of 10 years on the structural durability of its composite decking products under normal residential use, provided the products are installed, maintained, and used in accordance with the applicable KINGWPC installation and maintenance guidelines.

The warranty applies only to manufacturing defects that significantly affect the structural integrity of the product.

3. Warranty Conditions

The warranty applies only if:

• The products were purchased directly from KINGWPC or an authorised dealer.

• Installation was carried out in accordance with the latest KINGWPC installation instructions.

• Appropriate substructure, spacing, ventilation, drainage, and fastening systems were used.

• The products have been used for their intended purpose.

• Proof of purchase can be provided.

4. Warranty Exclusions

The warranty does not cover:

• Normal weathering, ageing, fading, colour variation, or natural surface changes.

• Minor dimensional changes due to temperature or humidity.

• Surface scratches, stains, dents, or cosmetic damage caused after delivery.

• Damage resulting from incorrect installation.

• Damage caused by inadequate ventilation or drainage.

• Damage caused by ground movement, flooding, fire, storms, lightning, or other force majeure events.

• Damage caused by chemicals, solvents, oil, salt, paint, or cleaning agents not approved by KINGWPC.

• Damage resulting from misuse, negligence, overloading, impact, or improper maintenance.

• Products that have been altered, drilled, cut incorrectly, or repaired by third parties.

• Labour costs for removal or reinstallation.

• Transport, installation, rental equipment, or consequential damages.

Steel mounting products are covered against manufacturing defects only. Surface corrosion caused by improper installation, aggressive environments (including coastal areas unless specifically suitable), mechanical damage, or misuse is excluded unless otherwise agreed in writing.

5. Inspection and Claims

Warranty claims must be submitted in writing as soon as reasonably possible after the defect has been discovered.

The claim must include:

• Proof of purchase.

• A description of the defect.

• Photographs showing the defect.

• Information regarding installation and maintenance.

KINGWPC reserves the right to inspect the products on-site or request return of samples before deciding on the claim.

6. Warranty Remedy

If a warranty claim is accepted, KINGWPC will, at its sole discretion:

• repair the defective product;

• replace the defective product with the same or a comparable product; or

• refund the original purchase price (or a proportion thereof where appropriate).

The warranty does not entitle the customer to compensation for indirect or consequential losses.

7. Consumer Rights

Nothing in this warranty affects the mandatory statutory rights of consumers under applicable Dutch law. Consumers remain entitled to the legal rights regarding conformity of products as provided under Book 7 of the Dutch Civil Code (Burgerlijk Wetboek).

8. Applicable Law

These Terms, the Return Policy, and this Warranty are governed exclusively by the laws of the Netherlands.

Any disputes shall be submitted to the competent Dutch court, without prejudice to mandatory consumer protection provisions under applicable law.
